SleepGainz by MudsTech — Terms of Use

Welcome to SleepGainz, a baby-tracking application and website operated by MudsTech. These Terms of Use govern your access to and use of SleepGainz, including our website, mobile applications, software, features, content, and related services.

By creating an account, accessing SleepGainz, or using any part of the service, you agree to these Terms. If you do not agree, do not use SleepGainz.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account or use SleepGainz. By using SleepGainz, you confirm that you meet this requirement and that the information you provide is accurate.

2. Your Account

You may need to create an account to use SleepGainz. You are responsible for keeping your login information secure and for all activity under your account.

You agree to notify us promptly if you believe your account has been accessed without permission.

You may request account deletion by contacting us at support@sleepgainz.com.

3. Purpose of SleepGainz

SleepGainz helps parents and caregivers record and organize baby-care information, including sleep, feeds, diapers, growth, medications, notes, and related tracking data.

SleepGainz is intended for personal organization and informational tracking only.

4. No Medical Advice

SleepGainz does not provide medical advice, diagnosis, treatment, or emergency guidance. Any summaries, reports, charts, reminders, or tracking information are based only on user-recorded data and should not be interpreted as medical recommendations.

You should contact a qualified healthcare professional for medical questions about your child, including questions about sleep, feeding, growth, medications, symptoms, or development.

If you believe your child may be experiencing a medical emergency, call emergency services immediately.

5. User Data and Baby Information

You may enter information about yourself, your child, and your caregiving activity. This may include names, dates, sleep records, feeding records, diaper records, medication logs, notes, and other baby-care information.

You are responsible for the accuracy of the information you enter.

SleepGainz may store, process, and display this information so the service can function. Our handling of personal information is described in our Privacy Policy.

6. Caregiver Sharing

SleepGainz may allow you to invite other caregivers to access a baby profile. You are responsible for inviting only people you trust.

Caregiver sharing is not enabled in the current release.

Caregivers may be able to view, add, edit, or delete baby-tracking information depending on their role.

Do not invite someone unless they are authorized to access that child’s information.

7. Your Responsibilities

You agree not to:

• Use SleepGainz for unlawful purposes.
• Enter false, misleading, harmful, or inappropriate content.
• Attempt to access another user’s account or baby data without permission.
• Share your password or misuse another person’s login.
• Interfere with SleepGainz servers, systems, security, or availability.
• Reverse engineer, copy, scrape, or misuse the service.
• Upload viruses, malicious code, or harmful content.
• Use SleepGainz to provide medical advice unless you are independently qualified and responsible for doing so.

8. Intellectual Property

SleepGainz, including its name, logo, design, software, text, features, and other content, belongs to MudsTech or its licensors.

You may use SleepGainz only for personal, non-commercial purposes unless we give written permission otherwise.

You may not copy, modify, distribute, sell, reverse engineer, or create derivative products from SleepGainz without permission.

9. User Content

You retain responsibility for the information and content you enter into SleepGainz.

By entering content into SleepGainz, you give MudsTech permission to store, process, display, and transmit that content as needed to provide the service.

We do not claim ownership of your personal baby-care records, but we may process them to operate, secure, improve, and support SleepGainz as described in our Privacy Policy.

10. Backups and Data Export

SleepGainz may provide tools to export your data. You are encouraged to keep your own backup copies of information that is important to you.

We use reasonable efforts to maintain the service, but we cannot guarantee that all data will always be available, error-free, or recoverable.

11. Third-Party Services

SleepGainz may rely on third-party services for functions such as:

• Hosting
• Authentication
• Email delivery
• Analytics
• App distribution
• Payments

These third-party services may have their own terms and privacy policies.

MudsTech is not responsible for third-party services that are outside our control.

12. App Store Terms

If you download SleepGainz from the Apple App Store or Google Play Store, your use of the app may also be subject to the terms of that store.

Apple and Google are not responsible for providing SleepGainz support unless required by their own terms.

13. Paid Features

SleepGainz may offer free and paid features. If paid features are added, pricing, renewal terms, cancellation options, and refund rules will be shown before purchase.

You are responsible for any charges, taxes, or fees associated with paid services you choose to purchase.

14. Changes to SleepGainz

We may update, modify, suspend, or discontinue parts of SleepGainz at any time.

We may also update these Terms. If changes are material, we may notify you through the app, website, or email. Continued use of SleepGainz after changes become effective means you accept the updated Terms.

15. Account Suspension or Termination

We may suspend or terminate access to SleepGainz if we believe you violated these Terms, created risk for other users, misused the service, or used the service unlawfully.

You may stop using SleepGainz at any time and may request account deletion.

16. Warranty Disclaimer

SleepGainz is provided “as is” and “as available.”

We do not guarantee that SleepGainz will be uninterrupted, error-free, secure, or that it will meet your expectations.

We do not guarantee any specific child-health, sleep, feeding, developmental, or parenting outcome.

17. Limitation of Liability

To the maximum extent allowed by law, MudsTech will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of SleepGainz.

This includes loss of data, loss of access, service interruption, or reliance on information entered into or generated by SleepGainz.

18. Indemnification

You agree to defend and hold harmless MudsTech from claims, damages, liabilities, costs, and expenses arising from your misuse of SleepGainz, your violation of these Terms, your violation of another person’s rights, or your unlawful conduct.

19. Privacy

Your use of SleepGainz is also governed by our Privacy Policy.

Do not use SleepGainz unless you also agree to the Privacy Policy.

20. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, unless another law is required to apply.

Any dispute will be handled in the state or federal courts located in Utah, unless applicable law requires otherwise.
